These Terms of Service ("Terms") govern your access to and use of the software, websites, and services provided by Aventran, Inc. ("Aventran," "we," "us"). By creating an account or using our services, you agree to these Terms.
1. Acceptance of these Terms
If you are entering into these Terms on behalf of a brokerage or other entity, you represent that you have the authority to bind that entity. If you do not have such authority, do not use the services.
2. Your account
You must provide accurate, complete account information and keep your credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access at security@aventran.com.
- You must be at least 18 years old and a licensed agent, broker, or otherwise legally entitled to market US real estate listings.
- One person should not share login credentials. Add seats for additional users.
- We may suspend accounts that show signs of compromise or abuse.
3. Fees and billing
Subscriptions renew monthly or annually based on your selected plan. Fees are charged in USD and are non-refundable except where required by law. The 14-day trial is free; if you do not subscribe at the end of the trial, your account is paused.
- Plan limits (qualified leads per month) reset on the first of each calendar month.
- Overage is billed at the rate listed on your billing page; we'll notify you before any overage charges.
- You may cancel at any time from your dashboard. Service continues through the end of the paid period.
4. Customer data
You own the data you submit to Aventran, including buyer conversations and lead records ("Customer Data"). We process it to provide the service, as described in our Privacy Policy. We do not sell Customer Data, and we do not use the contents of buyer conversations to train shared models.
5. Intellectual property
Aventran retains all rights to the platform, screening scripts we provide, and the software. You receive a non-exclusive, non-transferable license to use the service for your real estate business during your subscription.
6. Acceptable use
You agree to follow our Acceptable Use Policy, including TCPA, CAN-SPAM, state Do-Not-Call laws, and Fair Housing Act requirements. Among other things, you will not:
- Send messages to contacts who have not given prior express consent under TCPA.
- Use the assistant to discriminate against protected classes under the Fair Housing Act.
- Misrepresent yourself or the properties being marketed.
- Attempt to reverse-engineer, scrape, or overload the service.
7. Termination
You may terminate your subscription at any time. We may suspend or terminate your access if you breach these Terms, with notice where practical. On termination, you may export your Customer Data for 30 days, after which we may delete it.
8. Limitation of liability
To the maximum extent permitted by law, Aventran's total liability under these Terms is capped at the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
9. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Wilmington, Delaware.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or in the product at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
